User Responsibilities

Intellectual Property
Our Intellectual Property

Client Work
Upon full payment of all fees, you will receive ownership of the final deliverables as specified in your project agreement. However:
- We retain the right to display the work in our portfolio and marketing materials unless otherwise agreed in writing
- We retain ownership of any pre-existing materials, frameworks, or tools used in the project
- Source files and development assets may be provided at an additional cost, as specified in your project agreement
Client-Provided Materials
You represent and warrant that you own or have the necessary licenses for all content, images, and materials you provide to us. You agree to indemnify us against any claims arising from your provided materials.
Payment Terms
Payment terms will be specified in your project proposal or agreement. General payment policies include:
- Deposits: A deposit (typically 50%) is required before project work begins
- Milestone Payments: Additional payments may be due at project milestones as specified in your agreement
- Final Payment: Final payment is due upon project completion and before final deliverables are released
- Late Payments: Late payments may incur interest charges and may result in project suspension
- Refunds: Deposits are non-refundable. Refunds for other payments are handled on a case-by-case basis
All prices are quoted in the currency specified in your proposal and do not include applicable taxes unless stated otherwise.
Project Process
Timeline
Project timelines are estimates and depend on timely client feedback and material provision. Delays caused by the client may extend the project timeline and may incur additional fees.
Revisions
The number of revision rounds included in your project will be specified in your proposal. Additional revisions beyond the included rounds will be billed at our hourly rate.
Scope Changes
Any changes to the project scope after approval will require a change order and may affect the timeline and cost. We will provide a written estimate for any scope changes before proceeding.
Project Completion
A project is considered complete when all deliverables specified in the agreement have been provided and approved, or after a reasonable period without client feedback (typically 14 days).
Warranties & Disclaimers
We warrant that our services will be performed in a professional manner consistent with industry standards. However:
- Our website and services are provided "as is" without warranties of any kind, express or implied
- We do not guarantee specific results, traffic increases, or business outcomes from our services
- We do not warrant that our website will be uninterrupted, error-free, or free of viruses
- We are not responsible for third-party services, hosting providers, or platforms
We will make reasonable efforts to correct any errors or issues reported within 30 days of project completion at no additional cost.
Limitation of Liability
To the fullest extent permitted by law:
- Elkostart shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claims arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim
- We are not liable for any loss of data, profits, revenue, or business opportunities
- We are not responsible for delays or failures caused by circumstances beyond our reasonable control
Indemnification
You agree to indemnify, defend, and hold harmless Elkostart, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from:
- Your use of our services or website
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Any content or materials you provide to us
Termination
Either party may terminate a project agreement with written notice. Upon termination:
- You are responsible for payment for all work completed up to the termination date
- Deposits are non-refundable
- We will provide deliverables for completed work upon receipt of all outstanding payments
- We may retain copies of the work for our portfolio and records
We reserve the right to terminate or suspend access to our website or services at any time, without notice, for conduct that we believe violates these Terms or is harmful to us or other users.
Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration or the appropriate courts.
